Cannabis plants produce a unique family of terpeno-phenolic compounds called cannabinoids, some of which produce the "high" which may be experienced from consuming marijuana. Now 13, Jackson — whose diagnosis is undetermined — continues to use marijuana every day. (Like many patients, he ingests it in droplet form, which allows for more precise dosing and avoids lung problems.) He still has seizures, but they are less severe and they occur once every week or two, down from around 200 a month before he started using cannabis. In 2014, the South Carolina legislature passed S 1035/H 4803, also known as “Julian’s Law.” The law creates an exemption for the possession and use of CBD from the criminal definition of marijuana in limited circumstances. Only patients with severe forms of seizure disorders are eligible for legal protections after the patient obtains a recommendation for CBD oil from a physician.

The FDA’s refusal to allow companies to market CBD as a dietary supplement is based on the fact that federal classification as a dietary supplement requires that a substance has not been authorized for investigation as a new drug or medicine. Since Epidiolex has been studied in clinical trials by GW Pharmaceuticals going back several years now and was granted orphan drug status by the FDA in 2013, CBD cannot therefore be classified as a dietary supplement. Or so the FDA says. But cannabis companies are arguing that they started marketing CBD as a dietary supplement before there were any drug trials involving CBD, such that they should still be allowed to claim dietary supplement status for their products. Thus far however, the FDA isn’t budging on this issue.

Most human studies of CBD have been done on people who have seizures, and the FDA recently approved the first CBD-based drug, Epidiolex, for rare forms of epilepsy.
