Utah Patients with epilepsy are allowed to possess cannabis extract given they have a recommendation from a neurologist. The extract must contain less than 0.3% THC and at least 15% CBD. Users must register with the Utah Department of Health. The extract must be obtained in a sealed container from a licensed lab. We all know of Charlotte’s Web; the miracle strain that is packed with a high concentration of CBD. The leaves have a peculiar and diagnostic venation pattern that enables persons poorly familiar with the plant to distinguish a cannabis leaf from unrelated species that have confusingly similar leaves (see illustration). As is common in serrated leaves, each serration has a central vein extending to its tip. However, the serration vein originates from lower down the central vein of the leaflet, typically opposite to the position of, not the first notch down, but the next notch. This means that on its way from the midrib of the leaflet to the point of the serration, the vein serving the tip of the serration passes close by the intervening notch. Sometimes the vein will actually pass tangent to the notch, but often it will pass by at a small distance, and when that happens a spur vein (occasionally a pair of such spur veins) branches off and joins the leaf margin at the deepest point of the notch. This venation pattern varies slightly among varieties, but in general it enables one to tell Cannabis leaves from superficially similar leaves without difficulty and without special equipment. Tiny samples of Cannabis plants also can be identified with precision by microscopic examination of leaf cells and similar features, but that requires special expertise and equipment.[12]
Very few randomized controlled trials (RCTs) have been conducted using smoked cannabis (Campbell et al 2001) despite many anecdotal claims (Grinspoon and Bakalar 1997). One such study documented slight weight gain in HIV/AIDS subjects with no significant immunological sequelae (Abrams et al 2003). A recent brief trial of smoked cannabis (3.56% THC cigarettes 3 times daily) in HIV-associated neuropathy showed positive results on daily pain, hyperalgesia and 30% pain reduction (vs 15% in placebo) in 50 subjects over a treatment course of only 5 days (Abrams et al 2007) (Table 1). This short clinical trial also demonstrated prominent adverse events associated with intoxication. In Canada, 21 subjects with chronic pain sequentially smoked single inhalations of 25 mg of cannabis (0, 2.5, 6.0, 9.5% THC) via a pipe three times a day for 5 days to assess effects on pain (Ware et al 2007) with results the authors termed “modest”: no changes were observed in acute neuropathic pain scores, and a very low number of subjects noted 30% pain relief at the end of the study (Table 1). Even after political and legal considerations, it remains extremely unlikely that crude cannabis could ever be approved by the FDA as a prescription medicine as outlined in the FDA Botanical Guidance document (Food and Drug Administration 2004; Russo 2006b), due to a lack of rigorous standardization of the drug, an absence of Phase III clinical trials, and pulmonary sequelae (bronchial irritation and cough) associated with smoking (Tashkin 2005). Although cannabis vaporizers reduce potentially carcinogenic polyaromatic hydrocarbons, they have not been totally eliminated by this technology (Gieringer et al 2004; Hazekamp et al 2006).

There is an exception to sections 201(ff)(3)(B)(i) and (ii) if the substance was "marketed as" a dietary supplement or as a conventional food before the drug was approved or before the new drug investigations were authorized, as applicable. However, based on available evidence, FDA has concluded that this is not the case for THC or CBD. Research conducted at St. George’s University of London, found the two most common cannabinoids in marijuana, tetrahydrocannabinol (THC) and cannabidiol (CBD), weakened the ferocity of cancer cells and made them more susceptible to radiation treatment. Other studies have shown that medical marijuana treatments can slow the growth of cancer cells and halt their spread to other parts of the body.
The United States Federal Government does not define ‘hemp’ exactly, but they do define ‘industrial hemp’ to be any part of a cannabis plant, whether growing or not, that is used solely for industrial purposes (fiber and seed) with a THC concentration of no more than 0.3 percent when dried. In contrast, Hemp.com defines it as “the fiber and seed part of the Cannabis Sativa L. plant, opposed to the flower part of the plant which is ‘legally considered’ marijuana.”
There’s no definite amount that’s appropriate for everyone, but the ratio of CBD to THC will indicate how psychoactive the product is and if it’s legal in your state. The more CBD compared with THC, the less of a high, and vice versa. “Managing psychoactivity is key to successful cannabis therapy,” says Lee. “Amounts should be made clear on the label and lab-certified so people know what’s helping them and what’s not.”
Update January 1st, 2017:  The recent news stories of the DEA placing hemp based CBD as a schedule one substance have to do with marijuana, and accounting codes, not the above precedents, ie HIA v. DEA 2004, and the 2014 Farm Bill which already exclude hemp based cannabinoids from DEA regulation making whole plant hemp based cannabis oil legal when produced in accordance with state hemp program guidelines.  See noted cannabis attorney Bob Hoban's excellent blog post here for more details on this latest development. ​
